Offer to Purchase: Legal document that outlines key elements like purchase price, financing terms, and all the other details of the transaction.

 

Transfer of Land: Every purchase and sale will transfer legal ownership of real estate with a document called a Transfer of Land. This document will outline the buyers and sellers, the relationship of the owners if more than one, the legal description of the property, if anyone else holds an interest in the land, and how much was paid for the land. In order to file the Transfer, land transfer tax must be paid unless there is a valid exemption.

This tells the world that they hold a financial interest in the property that gives them special legal rights in case of non-payment or if other creditors claim an interest in the property later.

 

Status of Titles: These documents establish ownership of property. It is a public document, meaning anyone can do a search and get a copy of a Status of Title.

 

Title Insurance: Title insurance is an insurance policy that protects a property buyer’s interests, as well as their lender. Title insurance can only be obtained through a lawyer.
